Terms of Service

These Terms are an agreement between you and The Pointe of You LLC (“we,” “us,” “our”), operating thepointeofyou.com and the Student Portal (the “Service”). By creating an account, buying a membership, booking a lesson, or using the site, you agree to these Terms and our Privacy Policy.

Who we are

The Pointe of You LLC is an Arizona limited liability company. Avery Gay teaches through the Service. Contact: avery@thepointeofyou.com.

Who this is for

This mentorship is for dancers of all ages. If the dancer is under 18, a parent or legal guardian must create the account, complete checkout, and supervise use of the Service. By signing up you confirm you are at least 18, or you are the parent or guardian of the dancer named on the account.

Accounts

You are responsible for the email and password on the account, and for activity that happens under it. Use the same email for Cal bookings as the membership so lessons, credits, and the portal stay connected. We may close an account that is used to harm others, break these Terms, or abuse the studio.

Memberships

The Collective is monthly group training: Virtual Masterclass Saturdays 12-1 MST, recordings, the library, and the community chat. The Artist includes The Collective plus three private lessons a month (online or in person) and direct work with Avery. Artist spots are limited and require an application and video. Prices are shown at checkout and charged in US dollars.

Memberships renew each month until you cancel. Unused private lesson credits expire when the billing period ends. We may change prices or what is included with notice. Changes apply on the next renewal unless the law requires otherwise.

Classes, recordings, and privates

Live classes and Zoom rooms are for current members. Recordings are for your household’s personal training only. Do not share login links, Zoom URLs, or library videos. Private lessons and in person studio time are scheduled through Cal. Cal’s booking terms apply to that scheduling. Confirmation, reschedule, and cancel for a private are handled in the Cal email you receive after you book.

In person lessons

In person lessons are at the studio named on the booking (Club Dance in Queen Creek or Studio Z in Scottsdale), Tuesdays and Fridays, 10:00 AM to 3:00 PM Arizona time unless we say otherwise. Artist members who book with the membership email use a credit when one is left. Otherwise the posted per lesson price is billed after the lesson (card) or due at the studio (cash or check). You are responsible for getting the dancer to the studio on time.

Payments

Memberships and card invoices are processed by Stripe. We do not store full card numbers. You authorize recurring monthly charges until you cancel. Failed payments may pause access until the invoice is paid. Details on cancelling and refunds are in our Refund Policy.

Conduct

Treat Avery, staff, and other members with respect in class, chat, and the studio. No harassment, no sharing of other people’s images or videos, no recording of private lessons without permission. We can remove someone from class, chat, or the membership for conduct that makes the room unsafe.

Your videos and our content

Videos you submit stay yours. You give us permission to watch them for coaching, store them in the portal, and keep them while the account is open (and for a reasonable time after, as described in the Privacy Policy). Avery’s classes, recordings, writing, photos, and the site itself belong to The Pointe of You LLC or our licensors. You get a limited license to use them only as a paying member, for personal training. You do not get the right to copy, sell, or post them publicly.

Health and training

Dance training can cause injury. You (or the parent or guardian) are responsible for the dancer’s health, for telling us about injuries that affect training, and for deciding whether a class or lesson is appropriate. The Service is coaching, not medical care. By training with us you assume the ordinary risks of dance. Club Dance and Studio Z may have their own check-in rules and waivers for in person time at their studios.

Recordings

Virtual Masterclasses are recorded for the member library. You or the dancer may appear on camera. Those recordings stay inside the portal for current members. We do not sell them or use student footage for ads. Do not record a private lesson or share a class recording without our permission.

Email and notices

We email the address on the account for sign in codes, booking notes, billing, class changes, and account notices. Those messages are part of the Service. You can opt out of marketing email. You cannot opt out of transactional email while the account is open.

Other services we use

Payments run on Stripe. Scheduling runs on Cal. Live video may run on Zoom or a similar tool. Hosting, login, and file storage run on Vercel and Supabase. Their terms cover their part of the work. A problem on their side can affect class, booking, or payment even when we are doing our job.

Ending an account

You can cancel from your account at any time. We can suspend or close an account for unpaid invoices, Terms violations, or conduct that makes the studio unsafe. Closing the account ends the license to the library and chat. Refunds, if any, follow the Refund Policy.

Disclaimer

The Service is provided as is. We work to keep classes, the portal, and bookings running, but we do not promise uninterrupted access, specific competition results, or a particular training outcome. Live class times can move for holidays, illness, or studio conflicts. Recordings cover missed live sessions when a class is recorded as usual.

Liability

To the fullest extent Arizona law allows, The Pointe of You LLC, Avery Gay, and our teachers are not liable for indirect, incidental, or consequential damages, or for lost profits. Our total liability for a claim about the Service is limited to the membership fees you paid us in the three months before the claim. Some states do not allow certain limits. If that is you, those limits may not apply in full.

Arizona law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Courts in Arizona have exclusive venue, except where the law gives you the right to sue where you live.

Changes

We may update these Terms. The date at the top is the current version. If a change is material we will post it here and, when reasonable, email the address on the account. Continued use after the update means you accept the new Terms.

Other terms

These Terms, the Privacy Policy, and the Refund Policy are the full agreement. If a court finds one part unenforceable, the rest still applies. If we do not enforce a part one time, we can still enforce it later. You may not transfer your membership without our written okay. We may transfer the Service if the studio is sold or reorganized.
